The European Consumer Centre (ECC) Ireland is urging Black Friday and Cyber Monday online bargain hunters to remember that a reduction in price does not mean a reduction in consumer rights and, you can change your mind by availing of the 14-day cooling off period.
Irish consumers are urged to remember that not only do they have the same rights when buying goods at a reduced price as they do when it’s full price, but they can also avail of their right to withdrawal (online purchases only).
Exceptions do apply and some purchases are not covered by the 14-day cooling off period – for instance, hotel bookings, car rental, travel tickets and other leisure services (if the contract applies to a specific date or period of performance).
STRONG CONSUMER RIGHTS
Press and Communications Manager for ECC Ireland, Martina Nee, explained: "When you buy something in the sales, whether that’s online or in the shop itself, you have the same rights if the product is not in conformity with the contract, for example it’s faulty, not of merchantable quality, or not fit for purpose. That doesn’t change just because there is a reduction in the price.
"You’re entitled to request that the seller provides a repair or replacement, free of charge. If that’s not possible, is unsuccessful, or is not provided within a reasonable time and without significant inconvenience, then you can request a refund of all sums paid.
"When buying online, in sales or at full price, you have very strong rights when it comes to being able to change your mind without giving any reason. This is known as the 14-day cooling off period. So, that’s good news if you happen to buy something that you later regret but don’t take too long to make that decision.
"The 14 days kicks in from the time you receive the goods and once you inform the trader that you wish to avail of this right of withdrawal then you have another 14 days to return the goods. However, you may have to pay for the cost of returning it, so look for information about this in the terms and conditions or FAQ section before buying. However, if you buy your bargain in the actual shop and just change your mind then it’s up to the retailer’s own returns policy so always check what this is."
