Illegal fireworks seized in Kildorrery

Gardai seized a quantity of illegal fireworks in Kildorrery on Tuesday believed to be worth in the region of €2,000.

Gardai armed with a warrant, searched a house in Kildorrery on Tuesday and seized a quantity of illegal fireworks. It's understood the haul was worth €2,000. A 31-year-old male was questioned in relation to the find and a file is being prepared for the DPP.

A garda spokesman warned this week that they will be remaining vigilant between now and Hallowe'en, to ensure stocks of the illegal fireworks won't be brought into the area. They believe some people may be travelling outside the jurisdiction to purchase stocks.

Pointing out the risk of serious injury they pose, the garda spokesman indicated that, because they're so dangerous, they'll be operating a zero tolerance policy towards their stockpiling and use. There are serious penalties for those found in possession or using fireworks without a licence.

Under legislation amended in 2010, it is now an offence to have fireworks with the intention of selling or supplying to someone. It is also an offence to ignite a firework or cause it to be ignited in any place, not just in public. It is an offence too to throw or propel an ignited firework towards someone else or at property.

Anyone found guilty of such action, on summary conviction in the District Court is liable to imprisonment for up to six months or a fine or both. On conviction on indictment in the Circuit Court, the offender can receive a maximum fine of €10,000 or be sentenced to prison for up to 5 years or to both.

Gardaí have the power to arrest people without warrant if they reasonably suspect someone of having committed such an offence and can detain them in a garda station for questioning for up to 12 hours before the person is either charged with the offence or released.
