Fermoy estate residents to proceed with taking-in-charge plebiscite

Being “fed up” with their estate not being taken in charge, due to various reasons, the residents of the Dun Eala housing estate in Fermoy are set to take action of their own to progress the matter.

Residents of the Dun Eala estate in Fermoy say that, in the absence of any progress, they have no choice but to proceed with a plebiscite of residents to get the necessary agreement of the majority to apply to Cork County Council to take their estate in charge.

They're frustrated that they haven't heard from Cork County Council or the developer about starting work on a snag list they say has been outstanding since 2009. The county council first cited a boundary wall issue on the estate and a legal case surrounding it as the reason why matters couldn't be progressed. That legal case is now finished and planning retention for the wall has been applied for and granted.

"We're going to start our campaign next week. It's the only way. Residents will have to hold a referendum under Section 120 of the 2000 Planning Act. We are fed up waiting to have our estate finished," a spokesperson for residents told The Avondhu this week.

Minister of State Sean Sherlock said however that it is his understanding the developer has been in touch with Cork County Council to discuss the snag list. "I understand the developer has been in contact with the county council and there are some discussions taking place around the snag list and the quantity surveyance element of that process," he explained.

"The plebiscite issue is one that I would urge caution on. It is a useful tool in the residents armoury, but I'd prefer if they'd wait for official confirmation that the council and developer are going through the snag list before making a decision on a plebiscite. I assure them that myself and Councillor Noel McCarthy will keep the pressure on," he said.

Meanwhile, Cllr. Frank O'Flynn has tabled a motion for next week's meeting of the Fermoy Electoral Area Committee, calling on Cork County Council to put in place the process for taking the estate in charge.
