A concerned motorist has called on council bosses to deal with an overhanging tree that he says will fall and seriously injure or kill someone very soon.

Concerns have been made known to The Avondhu that the tree, on the roadside from Mitchelstown to Ballylanders, has been hanging in a precarious position for months and now that we are in the height of seasonal bloom, the extra foliage could cause the tree to fall over.

“It’s an accident waiting to happen. If the tree falls it could kill someone and then we’ll all be wishing something was done about it. The council or Gardai need to intervene to ensure that we’re not talking about another fatality on our roads in the coming weeks,” the concerned caller told The Avondhu.

Liability for trees and their branches as well as over-hanging hedges are issues faced by almost all landowners at some point but the law is quite clear on this subject, in that the land owner or occupier (that includes farmers renting land) are responsible for ensuring that hedges do not encroach and affect their neighbours' use of their land and also that trees are safe from falling branches.
